TERMS AND CONDITIONS
These Terms and Conditions must be read and signed as understood before starting a class with The Drop. Failure to complete this form prior to starting will result in the participant being unable to participate in the class.
1. THE DROP OVERVIEW
1.1
Classes
The Drop holds fitness and wellbeing classes within the studio for participants who are over the age of 18 years old, the only exception to this is the Mums Club where participants can bring their baby between the ages of 6 weeks to 12 months old. There is an additional policy for the Mums Club in which all participants for this class are required to sign.
1.2
Events/ Workshops
We may, at times, hold events such as, Hyrox simulations or exercise workshops of which the terms and conditions will remain the same as stated, unless we need to update these terms to align with the activity. We will notify you of these changes prior to the event.
1.3
Training Programmes or Recommendations
The Drop may provide training programmes or exercise recommendations for participants to complete at their own discretion and within their own time.
1.4
Limitation of Liability
Neither The Drop nor its instructors are liable for harm, personal injury or death arising from participation in any activities during the class or event/workshop unless caused by the negligence of The Drop and/or its instructors.
2. SCOPE OF RESPONSIBILITY
The Drop has instructors who are qualified Personal Trainers. Personal Trainers are here to help participants improve their physical health and mental wellbeing through exercise. Please note Personal Trainers are not medical professionals and are unable to advise the participant as to the suitability of any class or event/workshop. If anything arises that sits outside of this scope of practice the participant will be advised to seek the help of a medical professional.
3. BOOKINGS
3.1
All classes excluding Mums Club
We do not operate a booking system for our classes. The only exception to this is the Mums Club class. For all other classes, it is a drop in system which means you show up for a class 10 minutes before it begins.
3.2
Mums Club
We use The Drop | Baby & Toddler Classes Near Me | Happity as a booking system for Mums Club to help us control capacity within this class.
3.3
Events & Workshops
We will require bookings for events.
4. PAYMENTS
4.1
Drop In
The payments for all our classes, excluding the Mums Club, can be made on entry using the card machine. We prefer card payments but can accept cash on the door. The drop-in rate is £10. If paying for a drop-in class, all payments will need to be made upfront before the class starts. In the unfortunate event that you are late, the payment will be collected at the end of the class.
4.2
Mums Club
The Mums Club prices are £12 per session for an individual session which can be booked through Happity. The sessions are £10 per session when booked in a block of four consecutive sessions.
4.3
Rate Increases
Our rates are reviewed regularly, and we may increase them from time to time. We will notify you of any such increases. Any increases will take effect from notification to you (being no earlier than the date of that notification).
4.4
Refunds
We do not offer refunds on sessions, other than in exceptional circumstances at the discretion of The Drop.
5. DATA USE AND PROTECTION
5.1 By accepting these Terms and Conditions, you acknowledge that we will hold and process data about you to the extent necessary to provide our services to you.
5.2 We will take appropriate measures to prevent the unauthorised use or processing, or the loss or destruction of, any personal data you provide to us. Information you provide or we hold about you may be used by us subject to and in accordance with the Data Protection Act 2018 to assist in the provision of our services to you.
5.3 We will, unless you specifically ask us to refrain from doing so, use your contact details to keep you informed about other services and products provided by us. If you do not want to receive those kinds of communications from us then you may opt-out of receiving them.
5.4 Where we hold your Personal Data you have number of rights in respect of it. You may at any time write to us requesting a copy of your Personal Data (as defined by the Data Protection Act 2018). If any such data is incorrect you may request rectification of it.
5.5 If you are unhappy with the way that we have processed your Personal Data, you are entitled to make a complaint to the UK’s data regulator, the Information Commissioner’s Office.
6. HEALTH AND SAFETY
Please note that when you exercise there is an increased risk to your health and safety. To reduce the risk please follow the instructions below:
6.1
Accidents and Emergencies
In the event of an accident or emergency, The Drop’s instructors will perform First Aid on class participants. The incident will be logged, and serious incidents will be reported to HSE. Participants are consenting to receiving First Aid in an accident or emergency and consenting to their details of the incident being stored and/or reported.
6.2
Lighting
Our classes are lit by dim lighting. If this makes it difficult for you to see, which could pose a risk to your health and safety, please let the instructor know and they will be able to brighten the lights in the studio.
6.3
Training alongside others
When exercising please take care of yourself and other people within the class. Ensure that you and other members have adequate space to perform the exercises.
6.4
Exercise Guidance
Please take note of the technical guidance given by the instructor.
6.5
Damage to property
If you damage or notice damage of the property of The Drop, please inform the instructor immediately.
6.5
Personal Safety
When training, train at an intensity you are comfortable with and avoid overexerting yourself.
Stay hydrated throughout the class. If you experience pain whilst performing the exercise, please stop and let the instructor know. If you start to feel unwell, alert the instructor immediately.
Be aware of equipment and weights being on the floor as you move throughout the studio.
Be aware of the pillars in the studio. We have protected these with column padding for your own health and safety.
If you are running late, you will still need to ensure you complete a thorough warmup before commencing the session and is your responsibility to do so.
6.6
Infectious Disease/illness
Please do not attend the class whilst suffering from any infectious or contagious illness, disease, or other ailment or whilst suffering from a physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other participants.
7. HEALTH DECLARATION
‘I, the participant, am declaring that I do not have any known health or medical conditions which exercise could make worse and that in normal circumstances exercise should not harm me in any way. I shall inform the instructor of any changes to my health or medical condition prior to commencing the activity. Neither The Drop nor their instructors shall be liable to me for any personal injury which either I may suffer as a result of changes in my circumstances of which I was or should have been aware but failed to notify to the instructor and which the instructor would not have become aware by reasonable enquiry.
BY SIGNING THIS FORM, YOU ARE CONFIRMING THAT:
1. You have read, understood, and agree with the Terms and Conditions
2. The Drop is not liable for any harm, personal injury or death when participating in the training programmes or exercise recommendations, unless caused by the negligence of The Drop and/or its instructors.
3. That you will adhere to the Health and Safety Instructions given above
4. That you consent for The Drop’s instructors to provide first aid in an accident or emergency, and record and report the incident.
